According to Sullivan and Jacob, rather than understanding the needs of taxpayers in these tough economic times, the government still doesn't get it. IRS recently published 2009 statistics on Offers in Compromise. Based on the numbers it seems the federal government is not helping taxpayers through these perilous times. According to new statistics, the IRS accepted less Offers in Compromise by percentage than ever before.
Tax Year 2009 Offers Received 52,000 Offers Accepted 11,000
Tax Year 2008 Offers Received 44,000 Offers Accepted 11,000
Total number of Offers received for tax year 2009 was 52,000, an 18% increase from 2008. Total number of Offers accepted by the IRS remained at 11,000, putting the acceptance rate at around 20% of the total Offers submitted in 2009.
Fresh Start Tax experts believe this problem is caused by three factors. First, the market is flooded with false advertisements, "pennies on the dollar" settlements from non-professionals that are merely sales ploys. Second, taxpayers who do not know the criteria for an Offer acceptance are putting in frivolous offers. Third and most important, the policy at the IRS appears to be making OIC's tougher to get accepted and the IRS does little to help a person work through it. It appears as if the IRS looks to reject cases rather than work with a taxpayer for a compromise that benefits both sides.
